Više od dva stoljeća nakon izjave predsjednika Jeffersona, sloboda vjeroispovijesti još uvijek je daleko od poštivanja širom svijeta. Od diskriminatorske politike indijske vlade prema muslimanima do čestih terorističkih napada usmjerenih protiv kršćana na Bliskom Istoku, sloboda vjeroispovijesti još uvijek nije temeljno pravo nego privilegija. Na Ministarskoj konferenciji za unapređenje vjerskih sloboda, događaja koji organizira Američki State Department, američki predstavnik izjavio je kako "zaprepašćuje činjenica da 83 posto svjetskog stanovništva živi u zemljama u kojima je vjerska sloboda ugrožena ili se uopće ne priznaje".

Postoje brojni razlozi zašto se sloboda vjere još uvijek krši u 21. stoljeću. Kao prvo, niz država smatraju da religija ugrožava jedinstvo njihove zemlje. Posljednjih nekoliko godina bilo je nekoliko značajnih slučajeva kršenja prava vjerskih manjina. Na primjer, u Mijanmaru diskriminacija i nasilje su rezultirali bjegom 740 000 pripadnika naroda Rohindža iz zemlje, uglavnom u Bangladeš. Između ostalog, vlasti nisu priznale državljanstvo pripadnicima ove manjinske skupine, pozivajući se na zakon o državljanstvu Mjanmara iz 1982. godine. U Kini je vladajuća Komunistička partija neprestano kršila i dalje krši slobodu vjeroispovijesti, stežući kontrolu nad cijelom zemljom. Vlasti su napadale muslimansku manjinu Ujgure, ali i kazaške i kirgiske manjine, šaljeći ih u takozvane "Centre za strukovno obrazovanje i obuku" u Xinjiangu. Zapravo, ovi centri nisu ništa drugo nego zarobljenički kampovi. Na Tibetu se budisti suočavaju sa stalnim progonima, s prisilnom asimilacijom kroz mučenje i deportaciju. Neki redovnici su u očaju izvršiti čin javnog samospaljivanja. Nosilac najznačajnije titule u tibetanskom budizmu, Dalai-Lama, koji je trenutno u egzilu u Indiji, smatra da kineska vlada provodi "kulturni genocid". Kršćani se također suočavaju s diskriminacijom, jer vlasti redovito zatvaraju protestantske crkve. Primjer Kine pokazuje da svaka religija može postati metom politike koja krši slobodu vjeroispovijesti.

Tradicionalna vjerovanja i drugi vjerski pokreti su također izloženi progonima. Od animističkih i poganskih kultova do novijih pokreta poput Jehovinih svjedoka, postoji širok raspon vjerovanja koja ispovijedaju manjinske skupine i koja su  izložena redovitoj diskriminaciji širom svijeta.

Takva diskriminacija je također široko rasprostranjena pojava i među pripadnicima različitih grana iste religije. Napetosti između dva glavna ogranka islama, odnosno sunizma i i šijizma, koji na međunarodnoj sceni predstavljaju Saudijska Arabija i Iran, još uvijek snažno određuju politiku na Bliskom Istoku. Vjerske podjele su dodatni faktor koji negativno utječe na sadašnji rat u Siriji ili Jemenu i pokazuju koliko je takva (zlo)upotreba religije štetna. Slični događaji zabilježeni su u Europi, iako na nižoj razini. Do nekoliko incidenata je na primjer došlo u konfliktnim i spornim područjima poput Krima ili Gorskog Karabaha.

Na slobodu vjeroispovijesti također utječu i zakoni koji pokušavaju riješiti problem ekstremizma i terorizma. Zbog loše određenih granica koje se koriste za definiranje takvih rizika, politike vlada na kraju češće rezultiraju umanjivanjem prava vjernika nego borbom protiv ekstremističkih pokreta. U nekoliko zemalja zakoni usmjereni protiv muslimanske zajednice, poput zabrane burke u Francuskoj ili Nizozemskoj, su populističke mjere koje nastoje udovoljiti dijelu stanovništva, i nisu učinkovita metoda borbe protiv radikalizacije. Štoviše, strah od terorističkih napada i diskurs desničarskih i populističkih političara u Europi su rezultirali rastom islamofobije među stanovništvom. U Središnjoj Aziji, vlade koje su bile dio stare sovjetske nomenklature, boje se jačanja islamskog ekstremizma. Dakle, nešto bezazlezno poput brade se može smatrati znakom ekstremizma. U Turkmeniji su zabilježeni slučajevi da su policajci prisiljavali muškarce obrijati se samo zbog sumnje na ekstremizam.

Vlasti nisu jedine koje bi trebale biti tolerantne kako bi se osigurale vjerske slobode. Društvo u cjelini bi trebalo prihvatiti različitost vjerskih uvjerenja. U većini slučajeva netolerantne vlasti su posljedica netolerantnog društva. Unatoč postojanju zakona koji štite ljudska prava i jednakost, u nekim demokratskim državama vjerske manjine se često suočavaju s diskriminacijom u svakodnevnom životu, na primjer, ako traže posao ili stan. Antisemitizam je i dalje široko raspostranjen u mnogim zemljama. S obzirom da je antisemitizam posljedica stoljeća mržnje, ostaje i dalje veliki razlog za zabrinutost, jer su zločini poput uništavanja grobova ili crteži nacističkih simbola na židovskim spomenicima i zgradama i dalje raspostranjeni. Uzimajući u obzir pouke iz povijesti, potrebno je nastaviti borbu protiv te mržnje kako bi se spriječilo ponovno oživljavanje nacizma na najvišoj političkoj razini.


Tokom povijesti Romi su se također suočavali s diskriminacijom u odnosu na svoje vjerske prakse. U većini slučajeva Romi su prihvatili vjeru naroda s kojima su bili u kontaktu, ali i dalje se raspravlja o tome u kojoj je mjeri to bio rezultat prisilne asimilacije ili slobodne volje. Unatoč tome da su prihvatili vjeru većine stanovništva s kojim žive, Romi u Europi su bili često optuživani za krivovjerje zbog vjerskih praksi koje su bile dio njihovih ranijih navika i tradicija. To je doprinijelo stvaranju slike Roma kao nepouzdanih ljudi i rezultiralo je većom diskriminacijom u društvu.

Romi na Balkanu su bili pogođeni ratovima 1990-ih. U mnogim slučajevima progon je bio vezan s njihovom vjerom. Inače, kršenja slobode vjerskih manjina bila su česta pojava tokom ovih mračnih dana. Uništavanje crkava i drugih vjerskih objekata, ali i zločini usmjereni protiv vjernika zabilježeni su na cijelom području bivše Jugoslavije.

Iako se može činiti da globalna situacija u odnosu na slobodu vjeroispovijesti nije nimalo ohrabrujuća, postoje razlozi za optimizam. Prema posljednjem izvještaju Komisije Sjedinjenih Država za međunarodnu vjersku slobodu (USCIRF), neke zemlje su nedavno pojačale stupanj zaštite ovog temeljnog ljudskog prava. To vrijedi na primjer za Sudan. U travnju 2019. godine građani Sudana su srušili islamističku vladu koja je zamijenjena novom vladom. Nove vlasti su službeno priznale kako islam nije jedina religija u zemlji i trenutno pokušavaju osigurati slobodu vjeroispovijesti i vjerovanja, ali pred njima je dosta posla.

Međutim, kako bi se potpuno osigurala sloboda vjeroispovijesti, trebalo bi se više baviti ovim pitanjem i provoditi politiku, koja ima za cilj osuguravanje slobode vjeroispovijesti na međunarodnoj razini. Unatoč nekoliko akcija, čini se da tijela poput Ujedinjenih naroda i Europske unije nisu spremna štititi slobodu vjeroispovijesti kao što štite i druge slobode.

Po cijelom svijetu trebalo bi osigurati bolje obrazovanje o vjerskoj raznolikosti kako bi se povećala tolerancija. Istovremeno, trebalo bi uvesti sankcije protiv režima i organizacija koji krše slobodu vjeroispovijesti. Konačno, treba zabraniti govor mržnje na Internetu u vezi s bilo kojom religijom i izdavati sudske naloge za uhićenja u najtežim slučajevima.

Kako je izjavio trenutni Državni tajnik SAD-a Mike Pompeo „Sloboda vjeroispovijesti nije samo pitanje važno kršćanima, židovima, muslimanima, budistima, hinduistima ili humanistima. To je naša zajednička briga; to je briga svih!"

More than two centuries after President Jefferson’s statement, freedom of religion is still far from being respected around the World. From the discriminatory policies of the Indian government against Muslims to the frequent terrorist attacks targeting Christians in the Middle East, this Human Right is more of a privilege than the normality nowadays. An American representative, at the Ministerial to Advance Religious Freedom, stated that “a shocking 83 per cent of the world’s population live in nations where religious freedom is either threatened or denied entirely.”

There are numerous reasons why freedom of religion is still being violated in the 21st century. The first issue is linked with countries which officially consider a religion as a danger for their unity. In the past few years, several major violations of religious minorities' rights were disclosed. In Myanmar for example, discriminations and violence led 740 000 Rohingya people to flee their country, mostly for Bangladesh. Among other things, this minority has been denied citizenship by the authorities using the Myanmar nationality law of 1982. In China, the ruling Communist Party constantly violated the freedom of religion in an attempt to tighten his grip on the whole territory. They targeted the Uighur Muslim minority, but also Kazakh and Kirghiz, in so-called “Vocational Education and Training Centers” in Xinjiang. In fact, they are nothing else than internment camps. In Tibet, Buddhists are facing permanent persecutions, with forced assimilation through torture and deportation. The despair of some monks led them to self-immolation. The highest religious figure of Tibetan Buddhism, the Dalai-Lama,  currently in exile in India, considers the action of the Chinese government to be a “cultural genocide”. Christians are also facing discriminations, as the authorities regularly close Protestant churches. Thus, the example of China illustrates the fact that every religion might be targeted by policies violating the freedom of religion.

Traditional beliefs and other religious movements are also experiencing persecutions. From animist and paganist cults to more recent movements like Jehovah's witnesses, there is a wide range of minority beliefs that face regular discrimination in most of the world.

One should not forget that such discriminations are also happening between members of different branches of the same religion. Tensions between the two main groups of Islam, Sunni and Shia, respectively led by Saudi Arabia and Iran on the international scene, are still heavily shaping tensions in the Middle East. Ongoing wars in Syria or Yemen for examples are exacerbated by these religious divisions and show how damaging such use of beliefs still is nowadays. Similar events are reported in Europe, though at a lower scale. For example, several incidents were reported in conflict zones disputed areas such as Crimea or Nagorno-Karabagh.

Freedom of religion might also be affected by laws officially attempting to tackle extremism and terrorism. Because of the blurred lines used to define such risks, government policies often end up reducing the rights of believers more than dealing with extremist movements. In several countries, laws targeting the Muslim community, like prohibiting the integral veil called Burqa in France or the Netherlands, proved to be more of a populist way to please a part of the population than an efficient tool against radicalization. More generally, in Europe, the fear of terrorist attacks and the discourse of right-wing populist figures caused the growth of Islamophobia among the population. On the same way, in Central Asia, governments often coming from the old Soviet Nomenklatura are afraid of a rise of extremist Islam. Thus, something as simple as a beard might be considered as a symbol of extremism. In Turkmenistan, there were reported cases of police officers forcing men to shave for no other reason than this suspicion.

Finally, the authorities are not the only ones who should be tolerant to ensure religious freedom. Society as a whole should accept the diversity of religious beliefs. In most cases, an intolerant society comes along with an intolerant power. Nonetheless, in some of our democratic regimes, despite laws enforcing Human rights and equality, religious minorities are often facing discrimination in everyday life, for example, while looking for a job or housing. For example, antisemitism remains widespread in many countries. Being the result of centuries of hatred, it remains a major concern as crimes such as the destruction of graves or the drawing of Nazi symbols on Jewish monuments and buildings remain common. Considering the lessons of History, it is necessary to continue to fight against this hatred to prevent its resurgence at the highest political level.

Throughout History, Roma also faced discrimination regarding their religious practices. In most cases, they adopted the religion of the territory in which they settled, but it remains debated to what extent it was the result of forced assimilation or free will. In Europe, while becoming part of the religious majority, they were often accused of heresy because of some practices they kept from their previous habits and traditions. More generally, it participated to create the representation of untrustworthy people and led to more discrimination by society.

In Balkans, Roma were heavily targeted during the wars in the 1990s. In many cases, persecutions were linked to their religion. In general, violations of the freedom of religious minorities were common during these dark days. The destruction of churches and other religious buildings but also crimes targeting believers were reported on the whole territory of former Yugoslavia.

While the global situation of freedom of religion might appear to be mediocre, there are still reasons to hope. According to the last report of the United States Commission on International Religious Freedom (USCRIF), several countries recently enhanced the protection of this Human Right. It has been the case of Sudan for example. In April 2019, the Islamist authorities were taken down by people and replaced by a new government. The new authorities officially recognized that Islam is not the only religion of the country and are trying to ensure the freedom of worship and belief, even if a lot still has to be done.

However, to endorse this freedom to the fullest, the issue should be addressed more and policies should be enforced at the international level. Despite a few actions, bodies such as the United Nations and the European Union do not protect this freedom as strongly as they do for some others.

All around the world, better education regarding religious diversity should be implemented to increase tolerance. At the same time, regimes and organizations violating this freedom should be sanctioned. Finally, hate speech online regarding religious belongings should also be prohibited and lead to court arrests in the most serious cases.

Because, as stated by Mike Pompeo, the incumbent Secretary of State of the US, “Religious freedom isn’t just a Christian concern, a Jewish concern, a Muslim concern, a Buddhist concern, a Hindu concern, or a humanist concern. It’s all of our concern; it is everyone’s concern.”
